Civil servants lack independent tribunal

Civil servants have existing procedures to appeal administrative decisions, but an independent Administrative Tribunal, which would provide a separate avenue to challenge such decisions, has yet to be established despite being provided for in the Constitution.

Royal Civil Service Commission Commissioner Tshering Cigay said civil servants dissatisfied with decisions made at the ministry level, including performance management and evaluation (PME) ratings, can appeal to the RCSC.

However, he said the Constitution provides for civil servants to seek further recourse if they are dissatisfied with administrative decisions made by the RCSC, although the tribunal has yet to be established.

He said establishing the tribunal would require decisions and coordination among relevant agencies, adding that the RCSC was not responsible for establishing it.

“The RCSC is not responsible for establishing the Administrative Tribunal. However, we fully support its establishment,” he said.
